Any purchase of products from this site will be governed by these terms and conditions to the exclusion of any other terms and conditions; |

The prices shown on the Adventure College site are for online sales only. We are happy to accept orders by telephone or in person at Adventure College, but please be aware that different prices may apply to those shown on this website; |

Delivery |

11. |
Due to limited availability of some of the products we sell, a particular item may be out of stock at any given time; |
|

If this occurs, we will contact you and request your instructions for despatching the order; |
|
13. |
If you elect for your order to be sent in more than one shipment we will debit the second carriage charge from your credit card at the same rate as the initial shipment and only at the time the goods are despatched; |

14. |
We will keep you informed about expected delivery times (you can check the progress of your order by viewing your account and order status), but please leave up to 28 days for delivery; |
|
15. |
In stock items will generally be dispatched within 3 working days of receipt of your order but some out of stock products may take longer; |

Any delivery date will be an estimate only as we are in the hands of our suppliers and therefore may not have full control over expected delivery times; |

17. |
We shall not be liable for delays or other consequential losses caused by matters which are outside our control; |

If your order is required by a specific date or there is a deadline by which you need delivery, please ensure you make us aware of this at the time you place your order; |

Any claim based on any defect in quality or condition of the products at the time you receive them must be notified to us within 3 days of delivery; |

If you fail to notify us about any defects or damage within the 3 days specified above, you shall be deemed to have accepted the goods; |

You will have the option to specify the shipping method for your order at the checkout stage; |

We reserve the right to refuse shipment to certain countries; |

Risk of damage to or loss of the product shall pass to you at the point at which they are satisfactorily delivered; |

For UK couriered consignments we reserve the right to charge GBP £15.00 for redirection to an address other then the delivery address specified in your order; |

If no delivery address is specified consignments will automatically be sent to the billing address; |

Payment |

Payment is due at the time you place your order; |

Our product prices can be displayed in various currencies. It should be noted that your payment card will be debited in £ sterling - other currencies are purely for indication purposes only; |

You may use Paypal, MasterCard, Visa, Delta, Switch, Maestro, Solo, Visa Electron or JCB, or mail us a money order or personal cheque drawn in £ sterling; |

30. |
To convert to the currency of your choice, use the universal currency converter; |

Cheques or money orders should be made payable to "Adventure College Ltd"; |
|
32. |
Cash should not be sent by post unless by registered mail; |

We will not be responsible for cash sent by post and subsequently lost or not delivered; |

All prices in this site are subject to change without prior notice in the event of any increase in cost to us; |

We undertake full credit and debit card verification checks to help prevent mail order card fraud; |

We will report to the necessary authorities any person attempting to use a card which they are not authorised to use or which appears to us to be fraudulent; |

Property |

Title of goods remains with Adventure College and shall pass to you only upon receipt of cleared funds by us; |

Adventure College Ltd asserts all of their intellectual property rights in all of their promotional materials and trademarks; |

Warranties and Liability |

|

All products supplied conform to all relevant British and European standards; |
|
40. |
All products are supplied with a full UK supplier's guarantee, the details of which are available from us on request; |
|
41. |
If there is a defect in any product(s) sold by us to you, then we will replace the defective product(s) free of charge or if you choose not to have a replacement you are entitled to a full refund of the price paid for the product (or a proportionate part of the price); |

Your statutory rights are unaffected; |

Returning wrong size or faulty goods |
|

If any product that is purchased from us does not turn out to be the correct size for you then we will exchange it for the correct size provided that the product has not been used in any way and is returned to us in its original packing "as new" and able to be immediately resold by us; |

Any product that is returned for an exchange must first be notified to us by requesting a returns number (RN) - you can do this either by telephoning us or by e-mail; |
|
45. |
For goods that are the wrong size, you will be responsible for the carriage cost of returning the goods to us; |
|
46. |
We reserve the right to charge an additional carriage charge to you for supplying replacement items where the original item was correctly supplied but is the wrong size; |
|

If any product that is purchased is faulty we will exchange it for an identical replacement free of charge provided that the product is returned to us in its original packaging and the fault is notified to us as above; |

Before despatch of a replacement item, we reserve the right to have the fault verified, either by us or by the manufacturers; |

Any product that is returned as faulty must first be notified to us by requesting a returns number (RN) - you can do this either by telephoning us or by e-mail; |

At Adventure College, we want you to confident that you have our full support when making a purchase and that should any product prove to be faulty we will ensure it is repaired and return to you with the least disruption; |

Should you believe that any product you have purchased from us is faulty, first e-mail us letting us know what the problem is. Give us as much detail as you can. We will then discuss with you the best course of action to get the problem resolved to your satisfaction. If the item needs to be returned to us you can be assured either we or the manufacturers' technicians will remedy the problem as quickly as possible; |

Export |
|

If goods are to be shipped or used overseas, then it is your responsibility to ensure that the product is able to be shipped to and used in your country; |

We do not offer a refund (excluding faulty items) to countries outside of the European Union; |
|

Incorrectly sized items (suits and BCDs) (excludes cylinders) despatched outside the United Kingdom and inside the European Union can be swapped but customers are responsible for the cost of shipping the items back to us and then the return carriage costs, to return the goods back to the customer; |

Consignments despatched to addresses outside of the UK may only be sent to the registered billing address as held by your credit card company; |
|
57. |
Due to it being a circumstance beyond our control, we do not accept any responsibility for shipment delays due to Customs issues and/or for any customs duties, excise duties, import taxes or Value Added Tax levied on a consignment; |

58. |
We reserve the right to charge UK Value Added Tax (VAT) on export consignments, which we will then reimburse to you upon production of a valid certificate of export for the goods; |

Your right to cancel |

You may cancel your order and return the products to us and receive a refund at any time up to seven days after you have received the product(s); |

The product(s) must not have been used in any way and must returned to us in original packing "as new" and able to be immediately resold by us; |

To cancel or return all or part of an order you must notify us by requesting a returns number (RN) from us, either by telephoning us or by e-mail requesting that the order be cancelled; |

Carriage charges are not refundable; |

Customer Satisfaction |

General |

You are not entitled to assign or transfer any of your rights or obligations under this contract; |

This contract shall be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English courts. |

Dive Trips |
|
|
69. |
Adventure College Ltd undertakes to transport divers/passengers to and from the agreed site(s), to deploy and recover safely divers from the water and to provide standard safety and back-up facilities. Adventure College Ltd does not undertake to provide advice planning or recommendations relating to scuba diving practices. It is the individual responsibility of divers to dive within the limits of their own training and experience. |

70. |
Neither Adventure College Ltd or the skipper of Wight Diver are responsible for allocating dive pairs or teams. This is the responsibility of the Individual. |
|
71. |
In the event of a customer cancellation Adventure College Ltd will make every effort to resell the charter and if able to do so will refund money paid less any expenses incurred. If we are unable to resell the charter the following will apply: Up to ten weeks prior to charter full refund Four to ten weeks prior to charter loss of deposit Less than four weeks no refund If owing to circumstances beyond the control of Adventure College Ltd, Adventure College Ltd cancels the charter, a full refund or credit will be given. |

72. |
Adventure College Ltd is fully insured for bodily injury or accident to passengers on board to a maximum of £3,000,000 (three million pounds sterling). Our insurance does not cover charterers who are away from the vessel or its tender whilst engaged in diving or other water sports or activities. Adventure College Ltd cannot accept liability for loss or damage to personal property including diving equipment and that equipment left on the boat overnight is at the owner’s risk. |

73. |
The ultimate decision regarding the safety of the vessel, its crew and those on board rests with the Skipper. The final decision relation to the suitability of the weather for sailing or diving operations will be made by the skipper, whose decision is final. The skipper may cancel or amend the trip at any time if they believe the conditions are, or are likely to become unsuitable for the proposed trip. |

74. |
Adventure College Ltd and its crew shall not be responsible for any accident or injury caused to any person or persons arising out of diving or use of any equipment. The divers shall be responsible for ensuring compliance with all matters arising from the Merchant Shipping Act, the Protection of Wrecks Act and any legislation regarding the laws of salvage. |

Adventure College Ltd reserves the right to amend the scheduled charter in any way they consider appropriate due to adverse weather or any other conditions. They also reserve the right to alter prices in accordance with any major changes in cost which may occur between the time of booking and the time of departure. In the case of weekend bookings which have a lower threshold of acceptable weather conditions, e.g. the Moldavia or Fort Yale (or any other site which Adventure College may from time to time designate), Adventure College Ltd reserve the right to amend the dive site to an alternative one closer to Langstone Harbour, such alternative site being not less than a depth of 25m. |
